By signing this credit application, the customer authorizes Purcell Tire & Rubber Co. to obtain credit bureau reports and make other credit inquires that Purcell Tire & Rubber Co. determines necessary.

The UNDERSIGNED has read and agrees to all of the CREDIT AGREEMENT terms noted further down the page.

Continuing guarantee: To UNDERSIGNED ("Guarantor")personally and individually, jointly and severely, unconditionally guarantee and promise to pay to the Company, on demand, and all present and future indebtedness, obligations and liabilities of the Customer to the Company. The obligations of the Guarantors hereunder are joint and several and independent of the obligations of the Customer and a separate action may be brought against any one and more of the Guarantors whether or not action is brought against any other Guarantors or against the Customer, Guarantors waive any rights to have the Company proceed against the Customer or any security held from the Customer.

Credit Agreement

The undersigned authorizes the release of information for the named Trade Creditors and bank listed on the application. In consideration of an extension of credit by Purcell Tire & Rubber Co., Inc., the seller, in reliance upon the statement and representation contained in this credit Application may extend credit to the applicant company named in this agreement for the purchase or products and services. Credit may be extended on open account, by acceptance of company check, C.O.D. terms or by invoicing the terms requiring any form of payment other than cash.

If credit is extended , the applicant company agrees as follows:

1. To pay all invoices when due, according to the terms Net 10th on each invoice
2. That all past due invoices are subject to a finance fee equal to the legal rate of interest.
3. I am aware of the Purcell Tire and Rubber Co. credit card policy.
4. To pay all collection fees, reasonable attorney fees, court costs, and other expenses incurred by the Seller to effect recovery of sums due from the applicant company in the event of non-payment.
